Sorry, It Only Impressed the Heck Out of Me

As someone who manages a gazillion properties, I recently received a marketing package from the company that runs credit for me. I suspect they mistook me for an unsophisticated yokel with a single digit IQ.

The "package" they were selling was a "presentation solution" to give to potential landlords (sent to me presumably thinking I was a company that manages other people's rentals) to sway them to use me. I am sorry I threw out the letter which gave me the price for this presentation solution. I really am.

Here is the "Presentation Solution" they were providing me: an orange two pocket paper folder with three metal brad fasteners in the middle to hold the additional papers. A savvy shopper, could probably find the same folder at Wal-Mart for about 39 cents.

On the outside--as part of their demonstration, there is a typed post-it that says (and I am not making this up):

Deliver a "Tenant presentation" package that will
impress the hell out of a landlord

so he'll look to YOU for future tenants
and NOT your competition!








On the next page, in the first pocket was the following post it and sample lease application. Note the word "report" is missing a letter.


And, what a helpful hint about the business card. By the way, nowhere in their presentation solution is this company's name or contact number. I am not sure if I thought this gimmick up, I would include my name or number either.

The New and Improved Martin House


The house is ready for a family! Hopefully it will be rented out this weekend. There are three bedrooms upstairs, and one downstairs (on the other side of the shrub on the right side of steps).

Marty Sunshine likes barn houses. I am not crazy about them. But, it is a spacious home. It is in a quiet neighborhood and has a nice sized yard.

This is the new and improved kitchen. The varnish on the cabinets was worn. Carolsue painted the cabinets (and some of the ceramic tiles) and the walls. James added the floor.

A Real How-To Book

When I opt to change professions, I am going to write a book on real estate investing. Yes, I know there are real estate investing books out there. But the ones I have seen tend to gloss over the parts that really need much more explanation.

I have yet to see a real estate investing book or seminar that really goes into the true essence of being a landlord. All the books out there currently talk about real estate as a stream of income. As a long term investment. As a way to convert cash to an asset.

Whatever.

The books (and seminars) don't talk about when the economy tanks. If your tenants can't pay the rent because they have been laid off, it becomes your problem--whether is should be your problem or not.

The books don't talk about when the market goes down what happens then. If you wish to keep your credit score intact, you have to suffer through the idiots who whine about how their electricity bill and the rent are due the same day.

The books don't tell you what you are supposed to do when someone trashes your house. Yes, there is insurance. How much do you re-fix up the house? Really nice to attract a good quality tenant? Or just enough to attract the kind of person who will vandalize your home next time around?

The books don't tell you where you can find a crystal ball that will accurately predict if the house next door to you will eventually turn into a flop house, thus negating your ability to attract a quality tenant to your house?

The books don't tell you where you can find a good plumber/electrician/roofer who doesn't see dollar signs in their eyes when you call the to fix the broken gizmo and they find out you are a landlord. Because, aren't landlords rich?

My book will cover this. And more. Of course, nobody who read the book would probably want to be an investor at that point anyway. My book will not cover what to do when the tenant calls at 2 a.m. because the toilet overflowed. Because no tenant calls at 2 a.m. with an overflowing toilet.

As a real estate agent, I refuse to work with first time investors who are pumped because they spent the weekend prior at a a real estate investment seminar. Or worse, one who has read the latest it-is-easy-to-invest-in-real-estate-and-be-rich-next-week book. These first time investors are going to learn what the seminars and books don't really go into. And, when things do inevitably happen, I don't want them blaming me, the agent, for their school of hard knocks.

Really, I am Not Making This Up

There is a man in the Birmingham Police Force named--and I am not making this up--Officer Hooie.

I spoke with Officer Hooie on Wednesday morning when I finally got around to filing charges against the 508. Filing felony charges was actually a lot more satisfying than I expected. And, I got to fill him in on all the stuff I can't write about in this blog.

I don't know if the District Attorney's Office really will go after these clowns for vandalism. But I sure felt better. And, Office Hooie now has something to discuss around the water cooler.

Let the Garnishment Begin

The aliens apparently beamed Mr. Richards back to the mothership about two weeks ago. This is according to Red, who heard it from the neighbor. The neighbor happened to be awake at 2 a.m. when Mr. Richards skulked over, packed up a truck and headed out to places unknown.

According to Red, he left behind a great deal of his possessions. So, Carolsue will have a delightful time holding a yard sale or subcontracting Billy (the Martin home's next door neighbor) to haul everything to the dump.

There are some things that baffle me. The lawn was mowed this week--front and back. Carolsue stuck a note on door last Sunday. It disappeared on Monday. Why put tin foil on the windows after you move out? And, the foil-covered windows were cracked open one day last week.

Probably all could be explained. Maybe Mr. Richards is moving out little by little. Maybe a neighbor mowed the lawn? No offense to Southern hospitality, but this neighborhood doesn't exactly scream "neighborly." Who knows?

I sent Legal Eagle a note saying please garnish. Enjoy yourself. I certainly am. And, I sent Bliz a (hopefully) forlorn text asking her to take care of the utilities. (Thank you Bliz! I see toffee in your future... Consider this a complete bribe.)

In any case, good bye Mr. Richards. Now pay up.

(Im)Patiently Waiting

We still don't know what Mr. Richards is doing. If he is even there. Bobby the locksmith isn't available until Wednesday to meet Carolsue. As I recall from my other interaction with Bobby, "Wednesday" is a pretty nebulous amount of time anyway. It is very likely Bobby didn't actually attach a year to go with that Wednesday.

In the meantime, I called Red, who said he would swing by today and see if he could shake loose any humans living in the property. Red also gave me the most horrifying story of squatters. Essentially these guys moved into a friend's home and tore the place up. There was only the drywall surrounding the bathroom and the bathroom facilities intact by the time his friend found out.

Yep. Thanks Red. You ought to write children's books.

If Red is successful, and once he tells me if there is a vacant home, space aliens, squatters, Carolsue can meet Bobby over there to change the locks. If it is Mr. Richards who has decorated his windows with tin foil, Legal Eagle can finally file to start the eviction process--which will take a month or two and lots of billable hours. But at least the waiting will be over.

I Heard Snophix Is Delightful This Time Of Year

There is a theory being bandied around about Mr. Richards. Simply, he has been abducted by aliens. On occasion the mothership gets tired of him and releases him into the wilds of Birmingham.

In the event you might think this would be any different if Mr. Richards lived next door, I assure you, nope, it wouldn't be. There is a lease in place. Legally I don't have rights to the home unless I can prove abandonment or Mr. Richards decides to send me a postcard telling me he has moved on.

Our question arises because we just don't know what is happening inside the home. For example, the power is off at Mr. Richard's home. So, nobody is living there?

There is tin foil on all the windows. Carolsue put a note on his door last week and someone pulled it off. Then one day the windows were opened a crack. Therefore, someone is living there?

Because there is no power, Legal Eagle and I were theorizing perhaps there are squatters, taking advantage of a roof over their heads and a place to deal drugs. Of course, this is not an ideal situation, but a heck of a lot easier to handle than a tenant who refuses to move. With squatters, all I need to do is get the sheriff out there to haul their butts to jail.

However, there is now a new development. The lawn is mowed. So, if these are squatters, they are tidy squatters. If indeed the aliens got sick of Mr. Richards and sent him back to Alabama--to live in the dark--he took it upon himself to freeload from me with a manicured lawn.

There comes a moment when the law allows someone to act as a reasonable person. In this case, we cannot verify who is occupying the property--if anyone. Acting as a reasonable person, it is time to find out. Mr. Richards will not return phone calls (and never had e-mail). I find it hard to believe Mr. Richards is living in the sweltering heat, in the dark.

Monday Carolsue is going over with a locksmith to verify. The locksmith can open the home, and Carolsue can peek her head in and see what is up. If she finds someone other than Mr. Richards she can call the sheriff. If she finds Mr. Richards on a surgical table with residents from Planet Snophix standing over him with a scalpel, she can just politely close the door and call the National Inquirer.

In either case, I will then have an answer. I hope.

So Much for A Mundane Saturday

It is my weekend, darn it! I don't want to deal with stupidity. Alas, Ms. Betty wrote me back.

Ms. Betty said something along the lines of this wasn't her fault and me "of all people" should understand. I believe I have heard that one before. I wasn't all that thrilled last time someone said that to me either.

Neither Marty Sunshine or Carsolsue (who happens to be a paralegal) felt what I originally wrote back was appropriate for the occasion. However, what I originally wrote was a lot more fun than the dry "You have been put on notice, you will be evicted if you don't pay. I prosecute for trashed houses and I garnish wages" mumbo-jumbo I sent.

What I originally wrote was along the lines of "no other tenant has the nerve to ask if they can pay a month late. No other tenant has ever told me they can't pay the rent because the electric is due. No other tenant has been as much of a pain in my ass as you" (unless you count the others--but they aren't renting from me any more--and it would loose the punch to put the qualifier in there).

I am certain Ms. Betty will be furious with my e-mail. How dare I ask for what is contractually mine! I can't imagine she will actually leave. If she doesn't have the money to pay me, she doesn't have the money to move.

I find it interesting that the trashed 508 house, the vacant Martin home (which now has a roof leak), Mr. Richard's home (more later on that one) are all my biggest going concerns, but Ms. Betty is the one that aggravated me.

Zero to Bitch with One E-Mail

It appears I have lost all semblance of decorum. Though, I did manage to tone it down a bit when Ms. Betty wrote me today asking if it would be ok if she could send the rent a bit later than she was anticipating.

I managed to keep my answer to, "No it is not ok." Though that may not be as strong as "Hell no." I hope it drives the same point home.

I suspect I won't hear from her. If she does, the following response will be given.

"I have been more than patient with your incessant e-mails of countless ways of showing me how irresponsible you are. Your problems should not be my problems. Move your ass out or pay the rent. But don't ask me for anything. Ever. I am not in the mood."

Better yet, maybe I will just show her this blog.

One Down

I waited an extra week, and I could not find anyone else who wanted to rent out my house in Fultondale. Heaven knows I tried.

The ones I picked do meet all my requirements. They are gainfully employed. They meet my income criteria and then some. Rent on this house won't be a financial stretch for them. They are polite, well spoken. Their background check came out fine. Their credit report was what I expected. And, they haven't annoyed me with useless phone calls with a sense of entitlement.

About a year ago, I went through this exact scenario with another round of tenants. I didn't want them, but I took them anyway. Those folks worked out ok. They still rent from me. They pay and don't cause me any grief. There was nothing wrong with those folks either. I just didn't want them.

Marty pointed out that I am a bit burned out right now. There are many things happening in the background that I haven't documented that are clouding my judgement. "You aren't going to like anyone." he said. At this point, he may be right.

When I called to approve these people, I gave them a list of what I won't tolerate. Essentially, my list boiled down to: do not give me a reason to call you. Ever.

I explained I never wanted a call saying rent and the electric bill were due on the same day and what should they choose. Don't tell me your wallet was stolen. Don't tell me to hold the check for two days. And, don't sent me a post-dated check, a check with the wrong date or a check without a signature. I will cash it anyway. And, your check better not bounce--please see the clause in my lease about bounced checks.

I explained the neighbors have my phone number. And, if someone drives by the house and tells me there is a kangaroo living in the back yard, or a second chimney jutting out of the roof, or a three-car garage added to the property without my approval, all bets are off. I won't forgive. And, to drive the point home, I let them know I work with an attorney in Birmingham who specializes in wage garnishment. So, don't annoy me.

Is He or Isn't He?

I would like to go on record right now: Danny Haren should have been the starting National League pitcher for the All Star game this week. If you (and Marty Sunshine) don't care, that's fine. This my blog.

Now, where did I put Mr. Richards?

Weeks ago, Red--under Legal Eagle's direction--posted an eviction notice on Mr. Richard's home. We heard nothing. Carolsue drove past a few times and could not decide if he was still there. On one hand, the yard didn't have the Mr. Richards manicured look. On the other hand, the house didn't have a vacant look.

At one point, while debating this with Legal Eagle, she asked me what I wanted to do next: file with the court or wait a bit longer. Under attorney-client confidentiality, I explained to Legal Eagle that Carolsue was planning on looking for her cat. It might just happen to be in Mr. Richard's back yard.

So, if Carolsue drove by and Mr. Richards car wasn't there, she was planning on getting out of the car. She would then check and see if if her cat was in the back yard near the electric meter. If she happened to glance at the meter and it wasn't running, Carolsue would then peek in the window and see if her cat was inside.

However, before Carolsue was able to look for Fluffy, Mr. Richards--in one of his moments of psychic premonition--put foil on the windows, making sure nobody could see in or out. If Fluffy were inside, nobody would know.

Meanwhile, I have been twiddling my thumbs, pacing the floor and gnashing my teeth wondering why on Earth Mr. Richards didn't just leave. It didn't make sense. He isn't the type to hang out. He always struck me as the type to skulk out in the middle of the night instead.

While discussing my confusion about Mr. Richard's behavior yesterday, Carolsue mentioned his trash has been sitting by the side of the house for a week. This is so-unlike the immaculate Mr. Richards. Perhaps he did skulk out in the middle of the night.

This coming Thursday (theoretically), Baseball Guy will be heading on over to check out the house to see if the ghost of Mr. Richards is all that's left.

Now, Where Were We?

Ah yes! The 508 house...

Finn, the ultra-professional tightwad insurance adjuster doesn't deem the damage to be as high as the estimate I have received to fix the place up. Instead, he is offering me about one-third of the cost to fix it up.

And, because he isn't a complete ass, he is doing it in a very nice, polite way. Never has he suggested I manufactured the damage. Nor has he been anything but respectful--as in respectfully disagreeing he should honor this claim the way I want him to.

Actually, he is probably correct, though I loathe to admit it. The damage isn't as bad as first thought. The 508s did leave it a disaster, but there is little structural issues. Most of the damage is from slobs with domestic violence issues. Sadly, the slob factor isn't covered under my policy.

Insurance will cover the broken doors, windows and walls. They won't cover the bug bombs Carolsue used to mitigate the infestation of fleas, the debris removal--all now flea covered (the 508s left their furniture and much of their personal possessions behind) or any way to seal the floor from the dog urine smell. Those are my issues.

My other issues include the five-foot grass covering the half acre lot. I asked Billy (who lives next door to Mrs. Martin's former home) to go over and give me a quote. He said he would go that night. "No Billy. Do not head over there after dark, I cautioned." I didn't want to spell out why, but hopefully he figured it out.

Additionally, the air conditioner is still an unknown factor. Clay has been assigned to head over and check it out, but he can't do that until there is electricity at the house. There won't be electricity at the house until I am ready to have the work done. I won't be ready to have the work done until Carolsue is complete with my two other properties. And, I hear another one of her clients needs her too. So, it looks like it will be a week or two.

As a bright spot to this whole nonsense, Carolsue--bless her--has already started a campaign to find a new renter. She may have done so! A nice family that lives behind has other family members who may need a place to live. So, with any luck, this place won't be vacant too long.

Simple Pleasures

Ms. Betty e-mailed me on Wednesday. Apparently she has decided the electric bill takes precedence and is mailing her rent check later this month. I didn't really have a quasi-polite response to this, so I didn't write her back.

No matter, Carolsue will slap an eviction notice on her door in a few days. With Ms. Betty volunteering she is going to be late, why not start the process now? That way, if she really does come through at the end of the month, I can just stop the eviction. If she doesn't, I will be that much farther ahead of the game.

Somehow, sensing my displeasure at her first e-mail, Ms. Betty sent me a second e-mail moments later (which I also didn't respond to). It said:

"In Sept when get out of bankrupt we r going to be looking for another place to go."
I am not sure if this was a threat or a promise. In either case, I consider this great news. Let her go bug some other unsuspecting landlord for a while.

Covering My Assets

My problem with Monday's applicants is:

1. They didn't completely fill out the application
2. There seem to be some trust issues between the man and woman
3. Though unsaid, I am under the impression both parties sport a a bit of a past that should remain there.

My contention is, essentially why borrow trouble by allowing these people into my home? I am very uncomfortable with how this relationship between us has already started. Asking me to keep secrets and propagate lies isn't putting one's best foot forward.

And, if they can't be straight with each other, is this what I have to look forward to? What will be the fallout if we find out Mr. Applicant is really a cross-dressing transsexual and Mrs. Applicant just found out. A fight? Domestic violence? One party leaving and the other party not being able to make the rent.

And, who will foot the bill for their dishonesty? Yep, the landlord who just wants the house rented out to sane, stable people.

As of Monday afternoon, my head was swimming. So, at Marty's urging, I turned off my Birmingham phone and forgot about it until mid Tuesday afternoon.

What a wonderful treat! There were nine voicemail messages waiting for me. Two of them were from (hopefully) sane people whom I sent to Carolsue to show the property Wednesday morning.

Of course, there were a few others who were automatically disqualified for their lack of basic communication skills. For example, it is always a good idea to leave your name in your voice mail message.

Or, if I call you back, and say, "Hello this is the Landlord, you called me about my home for rent in Fultondale..." For Heaven's sake, don't answer with, "So. What of it?"

And, of course there is my least-favorite--when I call back someone back and the voice mail doesn't work, is full or the caller is not receiving messages (at their request). Do not call me back and say, "Did you just call me at this number?" My response to that clown was, "I might have. I called a lot of people back this afternoon."

Of course Delightful Dawn also called me. She wanted to know if I got her application and what the status was. I called her back and told her I had received another application and Carolsue was showing the home again Wednesday. After that, I would make a decision.

Delightful Dawn responded, telling me I was "unfair." She was there first. So therefore I had to rent the house out to her. Nope, I don't. Nor do I need someone who pouts before they even move in. What if the electric bill comes due the same day as the rent? Will that also be "not fair" if she is forced to choose between the two? Been there. Done that.

Round Two

I got another application today on Fultondale that is better than Delightful Dawn's, but not as wonderful as I want. I keep thinking, if I wait a bit longer maybe the "right" tenants will come along, show me they are stable, able to fill out an application and dazzle me with their ability to pay.

One item that jumped out at me was that they purposely neglected the last page of my application. How did they think I would miss the fact they completely skipped the page where I asked if they had a foreclosure, bankruptcy and repossession? Did they think I might forget about the fact I ask if they have been arrested for manufacturing illegal substances? And, if I am asking them, wouldn't it make a bit of sense I am going to check it out for myself too?

After talking with the folks, I mentioned I would be running credit and background checks--once they finished filling out the application. About an hour later, the woman called back. She told me about a few indiscretions in her credit past her guy just doesn't know about (which apparently is why there was a blank page). Does he have to find out? She asked.

My answer to her was for them to take the kids to the park that evening and discuss some of the things that might come up in a background check. I didn't want to play 13-year-old-girl games, talking to one, then the other, to get a straight story. I just want to rent out the house.

So, it would be prudent to get everything out in the open. Especially if there is more I am going to find out after the background checks. If there is more, it will sound a lot better coming from her, than from me.

And, just in case you are thinking, why not hold out for the next applicant, I got the following call Monday.

Caller: "Hey. I see y'all got a house to rent in Fultondale?"
Me: "Yes."
Caller: "Is it one level?"
Me: "No, it is a split level home."
Caller: "Do y'all have any other homes for rent?"
Me: "I have one in the Pinson/Trussville area coming up in a week or two."
Caller: "Is that one level?"
Me: "No, that is also split level."
Caller: "That's discrimination! I need a one level house."
Me (stupidly not hanging up): "It is not discrimination to have split level homes."
Caller: "Yes it is. I know my rights."
Me: "Do you want my attorney's number?"

Maybe these other folks are looking better and better.

Round One

Carolsue graciously gave up her Sunday afternoon to hold open the house in Fultondale. A holiday weekend. In the middle of another torrential downpour.

There were only two families that showed to view my lovely home. One of these belonged to Delightful Dawn, who happily turned in her application.

The other day she told me she needed to move NOW and had the money for move-in. I haven't even processed the application and the alarms are already screeching. First, the application is missing a few things--like required references. I need those for when they exit, not when they move in.

More to the point, there seems to be some discrepancy between who she told me would be residing in the property and who she put on the application to move into the home. Apparently it will be her, a smattering children, a husband/boyfriend-type and a person she calls her "mother-in-law" (though there doesn't seem to be a logical connection between the husband/boyfriend-type and the "mother-in-law").

This entire scenario looks like a train wreck in the making. And, the living situation sounds tenuous at best. Two alpha females under one roof? A husband/boyfriend-type person who may or may not have an attachment to Delightful Dawn or the "mother-in-law." And, most importantly, nobody has serious gainful employment. I can see it now, the first minor disaster and I would get an e-mail from one of them saying the dog ate their rent check.

Fortunately, based on my income ratio guidelines, they don't qualify. So, at least I don't have to go through the arduous process of finding an excuse to deny them.

Did She Really Ask This?

There are fleeting moments when I wonder if I will have enough blog fodder to continue posting tomorrow, next week or next year. After all, how much of a drama can one really have? Then, I get e-mails that remind me that as long as I have rental homes and (in some cases) nutjobs renting from me, there will always be something.

Sunday, I got the following e-mail from Ms. Betty:

"what do i do about my power bill if i pay u rent?


Essentially, she doesn't have the money to pay her rent and electric bill. What's a girl to do?

I didn't respond to Ms. Betty. But I will now.

Dear Ms. Betty,

Presumably, you asked my opinion about what you should do about paying your rent or paying your power bill. Let me simplify the decision process: it would be a waste of money to pay for electricity if you don't have a place to use it.

If that isn't motivation enough, I am chomping at the bit to get rid of you. My list of annoying tenants is diminishing and you are now close to the bottom. I need a hobby.

I understand times are tough. Guess what! They are tough for me too. Right now they are very tough. But I am not complaining to my mortgage company that I made the choice to have a gazillion homes in Alabama and now I have three vacant homes, a dead air conditioner, one deadbeat and one tenant who wants me to solve all of her financial hardships because she feels the need to choose between electricity and rent! These are my choices. I am sucking it up. I recommend you do the same.

But, how dare you make this my problem! I don't make my deadbeats your problem! I pay the mortgage--even when you are late. I hold up my end of the bargain. The bank isn't knocking on your door for the home back. You have a place to live.

If you need to come up with the money for the electricity, might I recommend taking on a part-time job, selling stuff on the Internet, cleaning houses, watching children or a variety of other innovative ways people on limited budgets throughout the world make ends meet. This isn't a unique situation.

I would like to caution you though, if something else mysteriously breaks in your home, I will not allow you or Mr. Betty to fix it. I will bring in Sid or Mr. 113. I am done.

First Impressions

Later today, Carolsue is going to open up my home on Fultondale and let those looking for a place to live peruse the inside. She doesn't answer questions, other than to say "I don't really know, you will need to ask the landlord." Then, if the prospective tenant has an interest in renting, Carolsue will give them an application and direct them to me.

That's it. That's all she is allowed to do. Because she isn't a licensed agent or the property owner, Carolsue isn't allowed to give any information about the home, the area or utilities. Nor can she tell me anyone's skin color, religion (though you might be astonished at the number of people who volunteer this) or national origin. This is Federal Law.

What Carolsue can do is observe and report what she sees. She can tell me if Mr. and Mrs. Delightful scream f-bombs at their children. She can tell me if Mr. Perfect wipes his feet when he walks in. She can (and will) tell me if Miss Wonderful tells Carolsue that I have already given permission for Miss Wonderful to paint the kitchen blood red. And, my all time favorite, Carolsue will tell me which prospective tenants asked if I would consider lowering the rent.

A lot is riding on some basic human interactions. A five minute conversation with Carolsue may make all the difference in where they end up living. Because, the first impression they make with Carolsue is going to affect their future with me.

Tenant Shopping

Vetting prospective tenants is like channeling a fickle shop-a-holic drama queen.

Monday it was Petunia Perfect and her charming e-mail. I called her back and left a message. She called me back and said, "Did y'all just call me on this number? Why did you call me? Who are you?" So... she can't listen to her voice mail? Not a good start.

Tuesday it was Virtuous Vera. She e-mailed me from her stable company. Her subject and verbs agreed. She used proper e-mail etiquette (spelled out words like "you" and "are" and did not type with all caps). She started with a greeting and ended with a closing paragraph. And, she included her name. I would have settled for just a first name, but no. I got both a first and last name. Generally prospective tenants like to be anonymous and use e-mail addresses like sweetbabymama(at)scaldmail.com

Wednesday it was Suave Sam, who told me his job was moving his family to the area. He could put the deposit down right away. And, would it be ok if he signed a two year lease? His wife apparently grew up across the street and they both grew up going to church the on the next block over. For some reason, prospective tenants wanting to impress like to tell me their church affiliations.

Thursday it was Delightful Dawn who asked for the property address to preview. She then called back on Friday to ask about the particulars. She is in a position to move in as soon as possible. However, she is more than happy to wait until Sunday--like everyone else--when Carolsue opens the house for viewing. However, she seemed a bit astonished that I would check her credit. "Is that really necessary?" She then quickly added, "I don't have anything to hide."

There are several more calls and e-mails on this property this week. But none of them match my accessories.

No Southern Hospitality

I had a lovely day on Wednesday--until I talked to Clay's former company. This is the HVAC firm I directed Ms. Betty to call for service, as Clay--who absolutely ROCKS--was busy installing a brand-new unit on my Fultondale home.

I have used this company for years. They have been to a good portion of my homes. When I call them, they have always stepped up.

It had been two days and I hadn't heard anything about the air conditioner from anyone. Nobody called me asking for payment. Ms. Betty, surprisingly unavailable for the first time since she started renting from me, hasn't responded to my e-mails, phone calls and the carrier pigeon I sent out.

My imagination was starting to feed me bits of negativity. What if the Betty's just skipping on me, instead of getting this fixed? What if I had another trashed home without a working air conditioner on my hands? I wasn't sure I was up to any more drama this early in the month. After a final attempt at Ms. Betty, I opted to call the AC company to verify the work had been done.

What a relief! It turns out this company went out to Ms. Betty's home. And, they managed to put a new thingy-gizmo on the unit for a beyond reasonable price. However, they hadn't called me for authorization or payment. If they had called me, I certainly would have authorized it. However they didn't. They took upon themselves just to fix it.

Because the AC company and I worked together for this long, I wasn't really bothered by the lack of communication for this particular incident. However, I wouldn't want this to happen again, lest next time it is a more expense thingy-gizmo or--Heaven forbid--a gadget, that breaks. So, in a proactive move with the person I was on the phone with, I opted to ask if there was some note that could be put in my file saying there must be authorization first, so there wouldn't be a "next time."

The person, obviously not the authority figure du jur, quickly put me on hold and put on the office manager instead. The office manager, completely misreading the situation, greeted me with a gruff: "So you are unhappy we fixed your air conditioner? How about if just go back out there and take it back off your house instead?"

Though I wasn't unhappy with the company until that very moment, my tolerance for BS is currently at an all-time low. Completely startled by this guy I replied with an equally snotty, "Why don't you just cut the sarcasm and actually listen to why I am calling? I wasn't annoyed with anyone until you got on the phone."

This got his attention and a few softened, "This is certainly not the way we do business.... We are so sorry ma'am, we should have called you first. I will speak to the technician..." type of responses. Too late, one annoying HVAC office manager later and I am through.

Looks like Clay made the right choice to jump ship. I think I will too.

In Other Wildly Inappropriate News...

The former tenant of my Fultondale home tried to Facebook friend me last Friday. You know, the one who flooded the laundry room, took all the flooring out of the extra bedroom, left the Christmas tree and four worn tires for me to dispose of in the shed? She apparently didn't own a working vacuum and never wiped a fingerprint off a wall for the entire two years she lived there. Yes, that one.

This is the second Facebook friend request from a tenant in a week.

Reading Between the Lines

Saturday late afternoon Ms. Betty called me. Her timing is impeccable. Right before she called, I had been toying with searching the obituaries, as I hadn't heard from her in weeks.

It turns out Ms. Betty's air conditioning went out. And, according to her, it was 85 degrees inside her home. And, according to her, she wasn't happy. And, she reminded me she has two young children. I am guessing the subtext was: Fix this. Fix this NOW.

I spoke my best Southern, "Oh bless your heart. You must be so uncomfortable." You may translate to: There isn't a whole lot that can happen until Monday.

However, my next suggestion was for them on Monday morning to call the AC company and tell them to come out there and fix the unit. (That would be Clay's former company, as he is BUSY Monday and can't make it out to Leeds).

I could tell Ms. Betty wasn't satisfied with this answer. But, she didn't say so. She just gave me a begrudgingly "Yes ma'am."

An hour later Mr. Betty called and told me it was hot in his house. He thought it was the air conditioning motor--in case I needed to know that. He also mentioned there were children in the home. You may translate that to: How come you haven't caught the first plane to Birmingham and are taking care of this at this very moment?

Because Mr. Betty is pretty handy, I asked him if he was able to legitimately find an air conditioning motor at that time of day. Or, if there might be a company open on Sunday that might be able to sell an air conditioning motor? If so, would he be willing to take care of this? For the sake of his children?

Nope. He didn't know of one.

"I think the best course of action would be to wait until Monday then, and have Ms. Betty call for service. Would that work for you?"

I got another "yes ma'am." But I don't think, in this case, it meant "yes ma'am."

Keeping Cool with Clay

Friday afternoon, Carolsue called me at 4:20 Alabama time to tell me the house in Fultondale is sans air conditioning. Argh! I wanted to show it this weekend. However, showing a home that doesn't have working air is a tremendous waste of time.

I quickly got off the phone with her and called Clay the AC Guy. Clay left his former company months ago. However, he managed to nab my number on the way out the door. I am pretty grateful for that.

There is a strange phenomena that I have noticed about those who specialize for a living. They remember obscure details related to their occupation. For example, my dermatologist can tell me (from memory) about every mole he has removed in the past six years from my body, what type it was and whether each one was malignant or not.

Clay is just the same with HVAC systems. He remembered the work on the air conditioner he expertly rigged last September. No kidding! The first thing out of his mouth after polite niceties and before we got to the gist of the call was, "How is that air conditioner holding up in your Fultondale home. It was pretty shot last year."

After deliberating, Marty and I have decided to replace the unit. Apparently, a new compressor costs almost as much as a new unit. So, come Monday, the home will have cool air. Marty and I didn't plan for this. But either we can put the air conditioner on now, or we can have Clay use chewing gum and duct tape to make it work and then replace it in a few months.

One of the REALLY nice things about air conditioners in Alabama is the cost. We were recently forced to replace the air conditioner on our personal residence. We are getting the same unit there for 1/3 the cost. Cool.

Mr. Partner and Me

I had lunch with Mr. Partner on Wednesday. The 508s weren't the only thing on the agenda, but of course, it is what we spent the majority of the time discussing. Mr. Partner wanted to make sure I am ok about everything.

Actually, I am. The house couldn't be worse. I think it is pretty much at its maximum for yuckiness. But, we have insurance. It will get straightened out. Who knows, maybe with the insurance claim we will add a basement, another bathroom, an indoor pool and a second story!

It really helps that we are of one mind about the entire thing. It also helps that we went through the nightmare of last summer. It prepared me for this. Make no mistake! This will be a migraine headache. But it is one property. Six homes at the same time is an aneurysm.

There are people I know who, after hearing about the 508 house, say they will only be a landlord if they are close to the property. Mr. Partner mentioned it wouldn't have been any different if we were next door. We wouldn't have been able to do anything until after the damage was done anyway.

I have been told by folks they will never be landlords because of people like the 508s who trashed the house. My advice is, please don't. It is rather unnerving when this kind of damage happens.

Mr. Partner and I don't have the emotional attachment to the home. This isn't a treasured family estate. It is an investment vehicle (or will be again at some later date). But, we see the potential. Real estate investing is risky. It isn't for everyone.

One of the really great parts about our lunch was talking about what was going right. There was a lot of that. We have many other homes that are currently working out. We have good stuff happening. And, that made the 508 home issue easier to swallow.

Mr. Richards Update

Two weeks ago, Mr. Richards called me to tell me he was sending the money he owed to me. It would be in the mail that day. I had no reason not to believe him because:

1. He took the initiative to call me.
2. He had usually been true to his word.

This time nothing came. I called with little expectations of reaching him to tell him what he already knew: the check didn't come. I didn't expect to hear from him, but I wanted to keep hope alive.

As soon as I got off the phone with Mr. Richard's voice mail, I called Legal Eagle and told her to do her magic. I don't know if he has been served yet or not. But, we all know how that goes.

Given I have the 508 situation on my hands, I am not excited about dealing with Mr. Richard's eviction. I would even be willing to work something out if he came through with some money. Just enough to let him limp along a teensy bit more before I kicked his butt out.

This past weekend I asked Carolsue if she might be willing to go over and have a chat with him. She happens to live directly across the parkway from him. Seriously, she could walk there in as much time as it would take to drive to his house.

Mr. Richards hasn't been home. Carolsue isn't in the business of harassing my tenants anyway. I certainly appreciate the effort, but this isn't what she signed up for.

So, it looks like Mr. Richards is going to leave. I am going to have to pay for Eaglet's first year at Harvard to get rid of him. But, Mr. Richards will pay me back. He's got a job. I know how to find him.

Rolling Forward

Before 8:30 today:

1. I Called the insurance adjuster, left a message.

2. I called an attorney (sadly Legal Eagle has to recuse herself on this one). The attorney said to press charges I needed to call the DA's Office.

3. I called the DA's Office. They told me to call the Magistrate's Office.

4. I called the Magistrate's Office. They told me to call Birmingham Police, homicide division (yes really).

5. I called the Birmingham Police and explained my situation. They put me through to robbery (I just couldn't ask for homicide).

6. The officer listened, told me I didn't have much of a case, offered to pray for me. After my insistence, she put me through to the East Precinct.

7. Sgt. Thomas at the East Precinct was already familiar with the case. She wasn't interested in helping me out. She said, unless I could "prove" the 508s did the damage, there was no case. I explained that Mrs. 508 admitted to me there was a broken window, a hole in the wall (that she told me she was planning on repairing) and an air conditioner that didn't work. Also, she talked with Carolsue this week and admitted she and Mr. 508 may had done the damage, but wanted more time to fix everything and it wouldn't be a problem.

I also explained to Sgt. Thomas we are looking at several thousand dollars worth of repairs. Sgt. Thomas acquiesced. She said once I got the insurance claim filed I could make a supplementary report and file felony charges against the 508s.

That made me feel better. Even nothing has happened of yet.

Hello! Now Please Don't Contact Me

I am in the business of providing a quality home for quality people. There is a contract and an exchange of money. I am fair. I am honest. And sometimes I am even a pushover. I am proud of what I do. I provide a service. I give people a place to live.

Right now, I like all my tenants. Even the ones who owe me money. I haven't always been able to say that.

Through experience, or more likely just through maturity, I have managed to separate me-the-human from me-the-business-owner. I can be friendly and know that there are times my tenants are being friendly because they may want a favor down the road. Sometimes tenants are this way. Sometimes they are just downright nice folks who just want to share.

I don't seek these people out. I don't e-mail them and ask how things are going in their personal life. In fact, I don't tend to e-mail or call my tenants at all. I like a certain degree of anonymity. I like the distance. It is nice to hear about the events in their life, but I am not a part of those events. I am just a spectator who only gets a snippet when they share.

When my tenant found me through Twitter, I realized how socially vulnerable I really am. It never occurred to me someone renting from me would seek me out. I don't think it was done as anything other than a well-intentioned friendly overture.

That said, I recently got a Facebook request from one of my tenants. I am absolutely positive this was just a kind gesture. She is a sweet person and under different circumstances, I would have said yes. But, there is a certain level of professionalism that must be maintained here. I thought that was pretty obvious. How many of us Facebook friend our boss or our banker?

One of my long-term tenants, who never contacts me, and I have never personally met, also e-mailed me today. Her mother died. Days later, her brother died. She told me she thinks of me as a friend and just wanted to share. I am flattered she thinks this highly of me. I am saddened by her loss and told her. But, I wouldn't go so far as to call her a friend. If she wasn't renting from me, I would hope she would be. She is a facinating person.

It isn't that I don't befriend the people who have rented from me. I can think off-hand of five former tenants I stay in touch with (two of whom are on my Facebook list). It doesn't seem appropriate to be pals until the business relationship is through. Maybe it is just me, but I wouldn't consider looking for Legal Eagle or Jack on Facebook.

So, in the event you are reading this and you are a tenant, please understand we are not friends. It isn't personal.

At Least the Roof Didn't Cave In

We were headed to Tucson Sunday afternoon to visit with family when Carolsue called. The exchange went like this.

CS: I want you to apologize to Marty right now for me.
Me: Why?
CS: Because you are about to be in a very bad mood.

Apparently there have been bad rainstorms in Alabama this weekend. The National Weather Service has issued warnings to gather the animals two by two. Reservations are being taken on the ark. I am quite thankful the skies opened up after I left.

However, according to Carolsue, my home in Fultondale now has an indoor swimming pool. The basement consists of a former one car garage now converted to a bonus room/storage room/office/fourth bedroom. There is also a laundry room and a finished basement turned into a family room. All of these rooms now sport about 1/2 inch of water.

Fortunately, the only room with flooring currently is the family room. Even more fortunately, nobody was living there with their personal possessions destroyed. No tenant is going to scream "toxic mold" because there is now water damage. That is interesting too--because there was no sign of prior water damage, so this is a new development or this is the first major flood in the area.

Carolsue--bless her--already assigned Sid to take care of this, assuring me the exterior wall needs some flashing and repair. Of course, I need carpet for the family room now. And, I already have a source for that too.

The water will dry. It will get fixed. It certainly is an annoyance. I am not excited about spending more time and resources on getting this repaired (it doesn't sound like it is enough for an insurance claim and I really, REALLY, dislike Alpha Adjuster enough that I don't want to even bother with something so small).

I never reached totally freaked out. And, I never hit "bad mood" because of this. I feel like I should be much more upset than I am. But I am not.

Home Sweet Home

I am sitting on my couch. Marty Sunshine knows I am tired and has graciously allowed me to watch baseball on "his" high definition TV. Marty has no appreciation for baseball. He even made me his deluxe grilled cheese sandwitches for dinner. Mmmm.. homemade food.

My trip was productive. I met with a mortgage officer who handles investors yesterday. Great meeting! He gave me some inspiring things to play with that may help us with our future company growth.

I also went back out to Fultondale yesterday and met Carolsue's nephew and helper, Jon. As he thinks I am "young" and "pretty" he is my new best friend. The work over there is coming along really well. I think Carolsue will have it ready for me to advertise for the weekend.

This morning I went back out to Mrs. Martin's former home to go over it with Carolsue. She and I went through looking for ways to "mac-daddy" it up. One option is looking at enclosing a room to make it a fourth bedroom. She is working with members of her syndicate to get me a quote.

Now that the water is on, we found out there is a leaky pipe /faucet at the washing machine faucet. As it took me several months to pay off the plumber last time I needed him, I did a quick prayer that the only decent plumber in Birmingham would take my calls. Turns out he will. Whew.

I also needed to pay next door neighbor, Billy. I gave him specific instructions: when the grass gets long, mow it. He can also park his car in the driveway of my home if he chooses. I would prefer it.

My final appointment was with Legal Eagle where we spent an hour and a half chatting about everything but lawyerly things. We then spent 2 minutes going over the other things I needed. As the 508s are supposedly moving out this weekend, I won't need to find legal counsel. I hope.

One of the major discoveries I made is how much more smoothly things run with Carolsue in the picture. I don't have to travel there as often--though I am planning on going back in the fall. My tenants are working out and Carolsue gives them a pretty thorough look-over before I ever get an application. All and all, it is going ok.

How I Spent My Summer Vacation

As I sit in my hotel room, showered, fed, I have been reflecting on my day. Today being my first full day in Birmingham.

This morning, I met Carolsue at the Fultondale home. The folks that moved out didn’t leave it as clean as I was hoping. Mind you, it isn’t bad. I certainly have seen worse. But, they left behind two years of fingerprints and dust. They didn’t own a working vacuum either.

My biggest complaint is they apparently didn’t know you are supposed to turn off the water to the washing machine before disconnecting. So there is a slight flood in the utility room—which is concrete. However, it spilled slightly into the downstairs den, which is carpet. I really should be more upset about this, but I am way too tired right now.

At the Fultondale home, I met three neighbors. The most curious of these folks came by early to ask Carolsue if she could have the potted plants left outside (which, now that I think of it is a bit nervy). I suppose this was her way of finding out the dirt on my tenants who left, as she actually returned the plants later that morning when I showed up. She then spent time hanging out with us looking for more information.

The other neighbors seemed much less nosy, with the guy behind this house giving me lots of details about the neighborhood Halloween customs and the neighbor two doors down innocently asking Carolsue if she was my mother. Here’s a quick tip, if you are ever in a situation where you are going to poke fun at Carolsue’s age, don’t do it when she is standing close enough to bop you. And no, Carolsue is NOT old enough to be my mother.

After Fultondale, we hightailed it across town (which in this case is 14.84 miles) to Mrs. Martin’s former home. True to her word, she moved. And, she left the place pretty clean too. Except every room is painted some sort of hideous color. For example, the kitchen is red. The master bedroom (which apparently was—I hope—where her daughters slept) is purple, yellow, pink and has a Bratz wall boarder. The kitchen flooring is in sad shape from years of wear and tear. The carpet is debatable. There is a red stain on the carpet that I think I made worse when I went to clean it. It is now pink and bigger.

While at Mrs. Martin’s former home, we met the neighbor. The neighbor dragged his son over with a friendly suggestion that Junior was out of college for the summer and for the love of all things holy could we please put him to work and get him off the couch?

This kid, by the way, looks just like Judge Reinhold’s character, Billy, in Beverly Hills Cop. Billy is now doing the lawn, changing out the locks and he took the children’s sandbox located on the upper deck of Mrs. Martin’s former home and drug it to the curb for me.

I also called James, the former hell's angel turned carpet guy for a quote for the kitchen vinyl and carpet for the rest of the home. James has already gotten back to me with his super-inexpensive quote (cash only). Someday I am going to ask James how he is able to get quality carpet at low prices. Come to think of it, I probably don't want to know.

After Carolsue and I parted ways, I ran over to the local hardware store and purchased new door locks, Kiltz and a few supplies. Carolsue is handling most of the supply gathering, as getting the homes ready to rent out really her job. But, my hope was that if I could get a jump on covering some of the obnoxious colors at Mrs. Martin’s former home she might be able to turn that place around faster.

It took me two and a half hours to use up one can of Kiltz on the red kitchen. The kitchen is now pink. It turns out that painting in the humidity is very different than painting in the desert. Paint actually rolls off the walls instead of sticking to the walls! And, paint tends to be more runny than thick. Not only that, in the desert, you can paint a wall and then roll on another coat five minutes later. If you try that in the humidity, the paint on the wall will stick to the roller. Thus again proving everything happens much slower in the South.

When I was done with the paint, I learned there is no water at Mrs. Martin’s former home. But I will deal with that Monday.

I So Need a Vacation

On my first trip out to Alabama several years ago, Marty Sunshine made an innocent quip about me just "taking a vacation." If you have ever been in a relationship or if you happen to be female, you know the type of look he he got.

My Alabama trip is not a vacation. It is a concentrated amount of work on a very tight time schedule with the luxury of having no time differences. In the past, I have been up at 6 a.m. and back to the hotel sometimes as late as 11 p.m. Generally my trip consists of errands and a ton of running around taking care of minor things that have been put on hold for the past few months.

I also meet with all the major players (lawyers, mortgage guys, some tenants and Jack) who have been going to bat for me for an extended amount of time and discussing with them what the next steps are. Because of the uncertainty of the economy and the housing market, I don't know what the future holds. They don't either, so we commiserate and brainstorm.

A lot of what I do while I am there is essentially relationship building. I get out for a dinner with Jack and Mrs. Jack. I have lunch with Legal Eagle too. These are all business appointments. We all like each other--which makes this much easier--but I am still on the clock. I am there to work.

I will also see Carolsue--which is always a hoot. I always learn about some obscure Southern tradition or Southern history hanging out with her.

I will be checking out my vacant homes immediately (Mrs. Martin assures me she is moving out today). I may also have to go attorney shopping, as soon as Legal Eagle hears all the dirt going on and can "properly" direct me to someone who can help me with my situation. Actually, I do have some Legal Eagle type things for her that are covered under attorney-client privilege.

Oh yes, there is the whole inspection thing. But, Carolsue is handling that.

I am an serious introvert by nature. As much as I like these people and am totally grateful for their support, seven days of constant human interaction drains everything out of me. I look forward to the flight home just so I can plug in my ipod and read a Rex Stout mystery. I don't pretend to be social on the plane ride home. It is just me, Clapton and Archie Goodwin. And those three hours of solitude are my vacation.

Not Lost in the Translation

The Alabama Department of Revenue sent me my yearly "You have not paid up and where the heck is our money?" nasty-gram.

Last year Diamond Jim handled this from May to December, with the Alabama Department of Revenue finally backing down. We were finally told by those nice folks in Montgomery, Oh wow! We found your payment! The check had been cashed. Sorry about that. Our bad.

I just got this year's late notice from the good ADofR folks telling me they didn't get this year's tax check. Which they did. In April. They also cashed on April 30.

I have told them so. I have sent them a copy (front and back) of the cashed check. And, I have sent them a letter where some clerk will probably get my letter and say something along the lines of, "Well bless her heart. She was probably just having a bad day." Which I believe is Southern speak for "What a bitch."

Ok, the letter wasn't nasty. But I did ask if there are some guidelines or procedures I am not aware of to streamline this process to avoid future potential late notices THAT I AM NOT OWED. I certainly hope I made it clear I don't want this to go on until December.

The Alternative Universe of Loan Modifications

I am trying to do a loan modification for one property. Actually, I would prefer to this for several properties. However, my life is currently in drive-by administrative mode--meaning I sit at the desk for about 10 minutes at a time. Just long enough to get 1/3 of any task done until the phone rings.

March 31:

I sent the loan modification paperwork to the bank, along with a letter explaining why I was looking into this. I sent them sales comparables. I sent them everything their Web site said I needed to send them.

May 1:

I received a letter (that they sent to Bliz) dated April 4. It said they made "several attempts to contact me" and I had 10 days from the notice of that letter to respond or they would be closing my file. As I hadn't heard from them during any of their "several attempts" I found this rather disturbing.

Afternoon of May 1:

After waiting on hold for an eon, the customer service representative explained they did indeed have my phone number and current address. Yep. They can reach me. I asked the customer service representative if there were notes in my file saying when they tried to reach me. The notes said they sent a letter out April 4. "That's it?" I asked. Yep.

The good news is--according to the customer service rep--all I needed to do was resubmit my loan modification on their new and improved form. He said to include my lease for the property and my 2008 taxes and I should be good to go. Otherwise, as it stood then, the file was closed. Good bye. Good luck.

Last Week

Because of time constraints I have have been working on this on and off ever since. Last week I got my 2008 taxes finished. Yippee!!

June 2 10 a.m.

Marty Sunshine provided me with his latest paystub and I was in the process of double checking everything before I hit the fax machine. I had my new six page form from the bank's Web site filled out, my hardship letter, two pay stubs, two month's bank statements, lease agreement, sales comps and 2008 taxes.

Because my fax machine is a bit challenges with more than a single sheet of paper, I was planning on taking this over to the local UPS store when I got out where they have a high-tech machine that actually can handle more than one piece of paper.

Through some sort of bizarre psychic premonition Olivia called (whom I guarantee her first language was not English). In her opening breath, completely bypassing all social niceties, she identified herself as a person from my mortgage company, asked me to tell her the address of my home and my social security number.

Me: Which home?
Olivia: The one you have with us.
Marty Sunshine (who is standing in the background seeing the purly puzzled look on my face): What is this about?
Me (to Marty Sunshine): Some woman is calling asking me to tell us our address and asking for our social security numbers to confirm who we say we are--even though she called us.
Olivia (hearing this): Wait! I am calling about your loan modification.

Olivia then repeats the address of the home where the loan modification paperwork is still sitting on my desk.

Apparently my "dead" file has somehow made it to Olivia's hands months later and she wanted to tell me I needed to go to their Web site and download new forms so that I can resubmit my request for approval. After not getting very far asking about how this "dead" file managed to get into her hands, I decided to see about the future. What I really wanted to know was how this processs works for an investment property.

Olivia didn't know. However, she was kind enough to find out. After putting me on hold for an eternity Olivia came back and told me the bank would not work with investors.

According to the representative I spoke with on May 1, the bank was handling investor loan modifications. According to the bank's Web site the bank is handling investor loan modifications. According to Olivia who called me out of the blue the bank isn't touching them.

I don't know what to believe. But, I can tell you this: A lot of time when into getting together all of the papers necessary and I am not giving up now. By golly if I had to fill it out, they have to read it.

The Carolsue Gang

Well, Carolsue seems to think there are big-time issues at the 508s. I am not saying I don't believe her. I just can't do much about until I had something concrete to go on--like rent being late.

In fact, Mr. Partner, who has been apprised of Carolsue's theories, and I are of one mind: while we are getting rent, let the rent come in and then deal with everything else eventually. Meanwhile I checked on Monday. Legal Eagle is still recused.

Rent is now late. So, Carolsue is heading over tomorrow to slap a lease termination notice on their door. She is also slapping an inspection notice on their door. An inspection notice says because there are lease violations (in this case tall grass), me or my representatives will inspect the property on Monday, June 8 at 10 a.m.

My representatives are Carolsue and her gang of merry inspectors. She has Baseball Guy, Jon (her nephew) and Andy, the convicted-murderer-turned-lawn-guy. Between the four of them, they should be able to tell me what is going on.

I am setting up my trip to Birmingham. I set up an appointment with an investment lender. He said that currently all of his clients are investors from Arizona. HUH? Attention Arizona investors: go invest in South Carolina and leave Birmingham to me. I was here first. This is my turf. _________________________________________

I asked Legal Eagle and Carolsue if they knew anyone marginally scary looking to go with me to inspect the property that I currently can't blog about. Carolsue, of course, had a few names for me.

To Stay or Not To Stay? That is the Question

At 5:36 A.M. Friday my phone rang with a text message. In the only coherent note I have ever received from Mrs. Martin, she asked for an extension to her move out date to June 5. Why? Because it was the last day of school.

Isn't the real question will she leave June 5 if I grant her the extension? Good grief! Why does she need to celebrate her child's last day of school in the same home? Is she going to feel the need to celebrate Arbor Day or Boxing Day there too?

I really feel like I should be deeply offended she even asked. But right now I can't seem to muster up the gall. I am settling for pretty annoyed. But as Marty Sunshine pointed out, June 5 is a lot sooner than waiting for the courts to do their magic.

The way I figure it, I could say no and Mrs. Martin would stay anyway. After all, I can't physically go over and remove her--even if I was there. I could say yes and she would still stay. I have no assurances she will actually leave on June 5--a Friday, a work day.

Legal Eagle said: "Let her stay, build a little good will and hopefully she won’t quit her job so we can garnish her!"

Instead, I went to Mrs. Martin with this: "I am coming in town. When I show up, there better be a clean, empty home."

Today's Potential Tenant Etiquette Tip

As a general rule, if you would like to make a good impression with your potential landlord, it is a good idea not to start the conversation by mentioning you haven't made a mortgage payment in a while and your company is cutting back your hours.

But that is just me.

The Cost of A Quick Phone Call

For the past week, I have kept up the chore of cleaning up the bits of cerebellum left over from my daily head explosion. This is directly due to the pending real estate transaction I am working on. Actually it can be completely attributed to the loan officer and his inability to call or e-mail once a day, keeping us apprised.

Isn't it amazing the number of times in our lives a simple phone call can make or break a relationship? I have a tenant who is on a widow's pension and social security. She is never late until this month. Because this is so unusual, last week I called her. Last week I also e-mailed her. She didn't contact me back. Instead she ignored me, probably putting her head in the sand, knowing what I was looking for.

After not hearing anything from her, Carolsue volunteered to call her before she went out there and handed her a lease termination notice. Apparently Carolsue's method worked. My tenant e-mailed me.

Her note was simple. Oops, something happened this month and here is how she is planning on making good.

It isn't that I wouldn't have worked with her had she told me this upfront. I would have been happy to oblige. I understand her situation. She has a steady income that will not be going away any time soon. She also doesn't have the money to move, so she and I are stuck for the time being. Theoretically, she is motivated to make this right. Given her background, I suspect I will see the money.

By not telling me when her situation changed and making me hunt her down is downright insulting. By the way, I did write her back. I let her know that I will work with those who keep an open lines of communication. And, it was a good thing I heard from her when I did, because I was about to have her evicted, which would have been an additional cost to her.

I am not sure she completely grasps what intrinsic damage she has caused. She has changed this relationship. By not contacting me immediately, she set herself up for no future favors. I won't consider going to any extra effort for minor repairs. Don't ask me for a reference to the local Rent-To-Own shop. And, don't expect I will be so gracious next time. And, all it would have taken was a quick phone call from her a couple of weeks ago.

Oh Please! Let There Be Light

There are very few things that could possibly make my head pound more than my current real estate transaction. Turning on the utilities to my vacant home is probably the closest. Maybe.

Now that Bliz has found better opportunities than staring at my financials full time, I am forced to take on some of her tasks (given to her by me). Granted Bliz is still working for me, but she is just not making it my priority. Darn her.

One of the tasks I took back from her was getting the power and water turned on at my vacant properties. How hard could it be? You fill out a form and the power/water/gas is magically turned on by the date I requested. Or at least that is what I thought happens.

It turns out, it is harder than it looks. There is more to it. A lot more. For example, nowhere on the Birmingham Water Works Web site does it give me a way to turn on water to my home, but their telephony system says to access their Web site for "faster service." I did find out--also through their telephony system the Birmingham Water Works is one of the "Top Five Water Systems in the Country." How nice.

I also did e-mail Birmingham Water Works and ask if I could turn the water on via the Internet. Every time I pushed the send button on my request, the Web page kept timing out. By the way, according to their site, the Birmingham Water Works is "considered to be the best tasting water in the South." I would say that too if I were afraid I wouldn't have water service.

After six years on hold, I finally talked to a live person. According to Diane, the world's most wicked customer service employee, I have a balance due. News to me. I am happy to pay the balance. But Diane couldn't help me. Nor would she let me turn on the water until my account is current.

Instead she told me she would be transferring me to a computer that would make me retype my account information three times before actually granting me my wish. Oh, before she transferred me, Diane chided, telling me if I had paid my bill when I was supposed to she could have helped me faster. I explained I never got a bill. Diane said, this wasn't her problem.

Note to Diane at Birmingham Water Works: I hope you get a flat tire. In the pouring rain.

Then there was Alabama Power's nonsense. After inputting several variations of the user name and password standards Bliz and I use, I was no closer to turning on the power than when I started. At one point, Alabama Power's Web site asked for the name of my dog before they would let me continue. However, I don't have a dog. I tried the name of Bliz's dog, along with a few alternative spellings, in case Fido is really spelled Phido, Fydo or Phydeau. No luck.

Finally I texted Bliz at her new job begging for help. Bliz offered her guidance but no concrete answers. I generally appreciate the zen-like atta-girl approach Bliz has towards my dilemmas, but not today. Today I wanted her to handle this. Or, at least by Friday.

They Can Run, But They Can't Hide

It really isn't fair to say I seek revenge on those who take advantage of my good nature. It is probably much closer to accurate to say I don't forget when I am wronged. Last year one of my tenants left me a huge mess and a owed me a lot of money. Of course, she preferred to disappear, figuring I would do the same.

Instead, attorney Mr. D. has been holding on to her file. At first he couldn't find her, and told me he would revisit this when I could give him something more concrete. You may translate that to: when I found her. No worries. I was up for the challenge. I have been biding my time, waiting patiently for her to show up.

Once in a while I would hit Facebook and Twitter and see if she had a profile. I knew she had one on Linkedin, but it hadn't been updated. I also checked the church she went to, seeing if she ever got a nod in the bulletin. She did on occasion. But no phone number or other information was ever posted.

As she owes me a significant amount of money, this lurking has been worth it. The other day I googled her name to find out she got married last December. She also graciously updated her Linkedin account. I know where she lives and I know where she works.

Mr. D. has been apprised of her new status. I am giving him a chance to garnish her wages. If he doesn't want the job, I am sure Legal Eagle will be happy to do so. Either way, I will get my money.

Near or Far

People sometimes give me a raised eyebrow on the occasion when I divulge this whole rental property in Alabama thing. "Why Alabama?" They ask. Then I explain a bunch of things they really didn't want to know anyway.

I finally figured out when people say, "Why Alabama" they are really asking, "Why not somewhere closer?"

I had a bizarre epiphany this weekend with tremendous help from my cyber-friend, Happy Camper. Managing properties at any distance really doesn't matter. Problems exist whether I am here or there. You think this would have been a bit obvious, given I have done this for years and I have managed properties less than five miles from my home.

In many ways being closer might be easier. I would see first-hand if there were problems and be able to jump on them faster--if I drove by the homes. When I had rental homes in Arizona, I never drove by them. There is a lot to be said for just collecting a rent check and letting Fate take its course.

Living closer might also make it easier to cultivate some relationships with plumbers, handymen and electricians. I am certainly not going to be the one to replace a hot water heater (though I probably could). But, I have managed to develop these relationships anyway. Besides, as Marty pointed out, I wouldn't personally meet these vendors here in Phoenix either.

Living farther away allows me to put some distance between the tenant's crisis and reality. Living farther away also makes it so my tenants don't expect me to jump late Friday afternoon of a holiday weekend when the air conditioner breaks. They know there isn't much I can do from here.

In many ways, my tenants who are farther away tend to be more self-reliant than those who lived in Phoenix. My Alabama tenants know there isn't much I can do for the broken towel bar. If they want to hang their towel up, they take care of it.

Living farther away also has a mysterious factor. I am often told by tenants that when I come to town, please let them know because they want to meet me. They want a face with the name. I prefer not to personally meet tenants. I have grown to appreciate a certain degree of formality. I am a lot more scary over the phone or via e-mail than in person.

For a while now, Marty Sunshine and I have been trying to convince Mr. Partner to employ a property management company. We have also bandyied about the concept of hiring a property management company for our two homes. A property management company would find me potential renters, collect the rent, start the eviction process if necessary and coordinate all repairs. All these things I have successfully done.

Not only that, a property management company would still contact me for a decision about the renters and payment for the repairs. I would still be on the financial hook for the eviction process (and they pick the lawyer), but there would also be a middle man involved. And, the property management company doesn't have any emotional attachment to whatever my issue happens to be. So, I would be working at their pace, not mine.

Hiring a property management company always boils down to a simple question, "Will the PIA factor be less for us for the amount of money we would be spending?" I don't think so.

Warning

Now that you have been warned, if you don't feel like reading along today, I certainly understand.

I have gotten several questions in the past few months about the pseudonyms on my site. As most of you know, my name isn't Fiona Dragon.

Fiona Dragon is a fictional character I made up to help teach my overly sensitive and highly-spirited daughter to read. As she wasn't willing to put any effort into reading for me, Fiona--grumpy and bumbling--would show up once in a while and threaten to eat Polly for breakfast if she didn't read something. Anything.

My daughter loved the concept. It stuck and evolved into its own shtick, with other characters such as Frieda Fussy, Bossy the Cow and Nosy Nelly showing up once in a while to tutor my daughter (and now my son) in a variety of subjects.

Now that I write about things legal and sometimes disturbing, it serves me well to keep the pseudonyms going.

My Crystal Ball

I am writing this right after getting back from my real estate client/neighbor's home. She is buying a home, leaving our quiet little patch of Mesa--if the transaction actually goes through. Which is debatable right now. I brought her over a bottle of wine to go with the bad news she needed to swallow. She was gracious enough to share.

My wine-induced relaxation is a nice by-product of a very stressful week which had very little to do with Alabama. Actually, a lot happened in Alabama this week. For the most part, I just ignored it.

Ok, not completely true. Because I have been so preoccupied with my real estate job, I just dusted off my crystal ball and figured out what would need my immediate attention next week. This was a useful bit of foreshadowing, as it will save me from lots of stress next week. Instead, I am dealing with next week's premeditated Alabama insanity this week.

For example, Carolsue got the call to serve one of my tenants. Her rent is late. After a phone call and an e-mail, I had no response, so she can serve away on Monday. I already sent Carolsue the notice. Oddly enough, I told Carolsue all this woman had to was call me back. Given the week I have had, I probably would have worked with her.

Additionally, I sent Legal Eagle Mr. Richard's file for her to work her magic. Yes really. When Mr. Richard's check didn't come this week, I left him a message telling me the only thing I would accept in his next voice mail would be him giving me the check number from his missing rent payment. I haven't heard back. I still might. It isn't hope and it isn't the crystal ball speaking here. Just a voice of experience. Legal Eagle will have him served on Tuesday. No, Wednesday. No Thursday...

I have the two homes Marty and I own together--with no other financial backing--coming vacant in a matter of days. If they don't come vacant, the way the tenants have declared they will, I will then have a bigger mess. But, I will cross that bridge when the wine wears off.

Knowing I have two homes coming vacant, I needed to make arrangements to have the utilities turned on. Normally I can do this from here, but if the tenants do not pay the utilities, it becomes more tricky. So, I needed to send Carolsue two powers of attorney to handle this. She will keep these safe until the moment comes that these properties are vacant.

Additionally, I am trying to set up a trip to Birmingham. Now that my real estate transaction is going into extra innings, I don't feel at liberty to leave as soon as I was hoping. Additionally, Marty Sunshine has a major deadline at work. Being the new guy, it isn't in his best interest to take time off work to watch the kids and/or ask for work from home favors only two months into his new assignment. So, I am coordinating a hypothetical trip at the moment. All the while, I am looking for hypothetical babysitting, as I don't have any actual dates. My crystal ball isn't that good.

Red Came Through

Well finally! Mrs. Martin and I agree on something--she needs to leave.

Apparently she jumped to this conclusion today when Red showed up on her door and handed her an eviction notice. Mrs. Martin did the only thing she ever does in these situations, she contacts me.

Today, however, she was a wee bit indignant that I was not "following through" on my end of our bargain, therefore she announced she will be out by May 31. This was news to me because I had no idea we had a "bargain." And, in the event we might have one, it would look like this: I let her live in my home, she pays me rent to live in said home.

At any rate, Mrs. Martin is now leaving. That is quite all right with me.

In her e-mail, Mrs. Martin did address the amount of money Legal Eagle says I am owed. Apparently Mrs. Martin did not add up the rents owed, late fees, legal fees and Red's processing fees. I didn't break down the numbers for her. She wouldn't like it anyway.

I did tell her to direct all future correspondence to my attorney. That actually sounds much scarier than it really is. All Legal Eagle will do is call me and say, "Guess what? You gotta hear this."

Legal Eagle is still filing an eviction against her. That will be the first step in the wage garnishment game--which I suspect Mrs. Martin is not fully aware is coming. It isn't that she wasn't warned it was happening. Legal Eagle explained it all in her letter: move out by the 15th or pay another month's rent, wages will be garnished and if there is any damage to the property I will prosecute.

Even though I think Mrs. Martin is in serious denial, I certainly hope Mrs. Martin is coherent enough to make sure the place is cleaned up. Because I am going to add the cost of Carolsue going in there there and taking her junk to the curb to her final bill.

The One-Man Band Comes to a Screeching Halt

Until yesterday, Mondays have traditionally been my work day. Up until yesterday, my home schooled kids were in "school" all day, playing with other home school kids and learning about bats, the desert and Dr. Seuss. Yesterday was the last day of school. Additionally, my babysitter/file clerk's parents have decided they should spend the summer in Canada, so I am not sure what the future holds for my "work days" at this moment.

Yesterday--my last official work day of the school year--was wasted with a mind-blowing migraine that started around 7:30 a.m. and lasted until Halloween. Marty Sunshine, who has a new position at work, had to come home and take the kids to school, because there was no way I was venturing into sunlight. And there was no way they were staying home (Marty was also was bandying around catch phrases like "aneurysm," suggesting he didn't want to scare me). In fact, I was so sick of the humming of the air conditioner, that if I had the strength I would have turned it off--even if it was 100 degrees.

When I did finally manage to lift my head, I found out I have missed three messages from Alabama. I haven't worked on the loan modifications and I haven't sent the bills to Bliz to pay. I also had a few Alabama e-mails of significance that need to be addressed, including one from Mr. 114 for some work he did and another from Carolsue wondering where her money is for some errands she has run for me.

The one e-mail that is painfully missing is from Legal Eagle telling me Mrs. Martin was served. So I guess that still hasn't happened. Too bad I took yesterday off, I could have called Red myself and asked him why this hasn't happened yet.

Teaching an Old Southern Man New Tricks

I firmly believe Mr. Richards is trainable. I am not sure exactly why I optimistically grasp to this ray of sunshine. Perhaps I just want him to be. Or, maybe because he has caught on little by little. For whatever reason, he still registers as a flake on my radar. Even after all these years.

Mr. Richards is on a payment plan that he has somewhat followed. He sent me enough money to keep him firmly situated in his home for a bit longer. However, he missed his next payment. More importantly, he neglected to call. I called him, telling him I really hated assuming the worst, but had no other idea what to think--unless of course he called me back.

To his credit, he called an hour later. He explained he was in no hurry to leave, and perhaps he could have made things a bit easier if he had called me last week when he knew he would be falling short.

Apparently Junior at some fried chicken and an errant bone stabbed his mouth with enough damage to require stitches. Mr. Richards needed the money he was sending me for Junior. Had he called me and just said that, he would have missed out on my pissy voice mail. I am starting to think he likes being yelled at. Or he is used to it.

Because Mr. Richards is almost caught up, he has a repreive for a few days. The remainder of his money should be here (according to his time schedule) by Tuesday or Wednesday. That is about par. I think he is good for it (but Legal Eagle is on notice).

But why do I think he can be trained? Because he promised me when he sent out this next check he wouldn't send it signature required.
